Govt Tells Private Schools To Vacate From State Land, HC Directs To Maintain Status-Quo

Srinagar: The High Court of Jammu and Kashmir and Ladakh has ordered to maintain the status quo on a plea filed by the petitioners against the closing of schools functioning on State or Kahcharai Land. 

Earlier, the officers of the School Education Department said that the authorities has directed them to vacate private schools that were functioning in the State land.

In this regard, they also received the list of all those private schools that were functioning from the State or Kcharaie land.

After hearing the petitioners, the court ruled that it is satisfied that the petitioners have prima facie made out a case for ad-interim relief at this stage.

The court stated that subject to objections to be filed by the respondents and till next date of hearing, status quo, as on date, shall be maintained.

It further stated that the case is listed on July-18.

Moreover, the CEO said that the HoIs have been asked to issue the school leaving certificates in favour of their respective students so that they will be accommodated in nearby government schools, subject to the consent of their parents in this regard.

“The matter is of urgent nature and there is no scope of any kind of laxity,” he said.

“According to the list provided by the revenue department, there were nearly 50 such private schools in Budgam district that were functioning from the State or Kcharaie land.”

Meanwhile, another CEO wishing anonymity said that all the CEOs of Kashmir valley have received the same order from the revenue department wherein they were given a list of private schools that were functioning from the State or Kcharaie land.

On Tuesday, the Jammu and Kashmir government banned schools run by the socio-religious Falah-e-Aam Trust (FAT), a body affiliated to the Jamaat-e-Islami (JeI) that was banned in 2019.
